Shixar Terms of Use
Legal contact: legal@shixar.com
1. General provisions
These Terms govern the use of the Shixar mobile application, the website available at shixar.com and related electronic services, jointly referred to as “Shixar”.
The provider of Shixar is Maciej Szwed, a natural person not conducting a registered business activity, address: ul. Leonida Teligi 4/61, 30-832 Kraków, Poland, e-mail: support@shixar.com, hereinafter the “Service Provider”.
The Service Provider can be contacted at: support@shixar.com (technical support), contact@shixar.com (general contact), privacy@shixar.com (privacy), legal@shixar.com (legal matters) and security@shixar.com (security).
Shixar is a tool intended primarily to organize the day-to-day work of hospitality teams, in particular kitchen teams. It may also be used individually, privately or for testing purposes.
Shixar may enable, among other things, the creation of Workspaces, inviting members, managing roles, maintaining recipes and private recipes, production lists, schedules, menus and reports, and adding photos, descriptions and notes.
The scope of features may change as the Service develops. Not all features need to be available at the same time on all devices, systems or markets.
As of the effective date of these Terms, Shixar is provided in a free version. The introduction of paid services in the future does not automatically create an obligation to pay; the price and conditions will be presented before purchase.
Use of features requiring an Account requires reading and accepting these Terms to the extent required by the registration process. Information about personal data is provided in the Privacy Policy.
2. Definitions
“Account” means an individual User account requiring authentication.
“Workspace” means a separate work area for a User or team; it does not have to correspond to an actually existing restaurant or business.
“Workspace Owner” means a User with ownership or administrative permissions in a given Workspace.
“Workspace Member” means a User with access to another User’s Workspace.
“Role” means a set of permissions in a Workspace. Current roles may include, in particular, Owner/Chef and Cook; their names and scope may change as Shixar develops.
“Content” means data and materials entered into Shixar, including recipes, ingredients, instructions, photos, production lists, menus, schedules, reports, descriptions and notes.
“Private Content” means Content intended, according to Shixar functionality, only for a specific User, in particular private recipes.
“Consumer” and “Entrepreneur with consumer rights” have the meaning assigned to them by applicable law.
“Organization” means a business, restaurant, employer or other entity on whose behalf an authorized User uses a Workspace.
“DPA” means the Shixar Data Processing Agreement, the current version of which is available at https://shixar.com/en/dpa.html.
3. Technical requirements and security
Using Shixar requires a compatible device, Internet access and an appropriate version of the application or browser. Some features require an active Account and login.
The User bears the cost of Internet access in accordance with the agreement with their provider.
Shixar may require updates. Older versions may cease to be supported for security, compatibility or maintenance reasons.
The User should appropriately protect their password and device and should not share login credentials with other persons. The Service Provider should not request that a plain-text password be sent by e-mail.
Suspected unauthorized access or another security event may be reported to security@shixar.com or support@shixar.com.
The Service Provider applies technical and organizational measures appropriate to the nature of the Service, but does not guarantee complete elimination of interruptions, errors, failures or threats.
4. User age
Shixar is intended only for persons who are at least 18 years old. Creating an Account by a younger person is prohibited.
Where there is a reasonable suspicion that the age requirement has been breached, the Service Provider may take steps to clarify the situation, restrict access or delete the Account in accordance with law.
5. Registration and Account
Creating an Account requires providing a first and last name, e-mail address, password and re-entering the password to verify that the entries match.
The User should provide information consistent with the facts and must not unlawfully use another person’s data.
The User is responsible for maintaining access to the e-mail address assigned to the Account. Shixar may require confirmation of the e-mail address.
After an Account is created, Shixar automatically creates the User’s own Workspace in accordance with the current functionality.
The Account is assigned to a specific User. The Service Provider may make additional login methods available in the future.
6. Workspaces, roles and invitations
A Workspace may be used individually, by a team, restaurant or other entity, and may also be used privately or for testing. Shixar does not verify the mere existence of an entity indicated by a User.
The Workspace Owner may, within available functionality, manage members, invitations, roles and Content. Individual members may have different permissions.
A person with appropriate permissions may invite another person by providing that person’s e-mail address. The invited person may accept or ignore the invitation.
The person sending an invitation should be authorized to use the specified e-mail address for that purpose.
Removing a member from another person’s Workspace causes loss of access to that Workspace, but does not delete the member’s individual Account or their own Workspace.
Content created as part of shared team work may remain in the Workspace after the author is removed from the team. Private Content remains separate.
If a Workspace is used by an employer, restaurant or business, the entity using Shixar is responsible, within its scope, for the legal basis for processing personal data of persons whose data it enters into the Workspace.
If a User uses a Workspace on behalf of an Organization, the User represents that they are authorized to act on its behalf with respect to the use of Shixar and the acceptance of applicable data-processing terms.
If the Organization is the controller of personal data placed in the Workspace and Shixar processes such data on its behalf, the DPA forms an integral part of the agreement to that extent. The current DPA is available at https://shixar.com/en/dpa.html.
A person who is not authorized to bind the Organization to the applicable terms should not use Shixar on its behalf to process personal data until appropriate authorization has been obtained.
7. User Content and files
The User retains the rights they hold in Content entered into Shixar. Merely storing Content does not transfer intellectual property rights to the Service Provider.
The User should have the rights, consents or other legal grounds required to use uploaded materials.
The User grants the Service Provider a non-exclusive and limited right to technically store, copy, transmit, synchronize, display to authorized persons and otherwise process Content as necessary to provide, secure and maintain Shixar and to comply with legal obligations.
This permission does not allow the Service Provider to freely sell recipes, photos or other User Content to third parties.
The User should exercise caution when uploading photos or information about other persons and should not include particularly sensitive data unless this is necessary and legally justified.
8. Prohibited Content and activities
The User must use Shixar in accordance with law, these Terms and the intended purpose of the Service.
In particular, it is prohibited to enter unlawful Content, infringe third-party rights, impersonate other persons, distribute malicious software, bypass security measures, obtain unauthorized access or disrupt infrastructure.
In the event of violations, the Service Provider may take measures proportionate to their nature, including restricting access to Content, features, a Workspace or an Account, subject to applicable law.
9. Account and Workspace deletion
The User may initiate deletion of their Account using a function available in the Application. Information about deleting an Account without access to the Application is available at https://shixar.com/delete-account.html.
Account deletion is permanent, subject to data that the Service Provider is entitled or required by law to retain.
If the User is the owner of a Workspace, deletion of the Account may permanently delete the Workspace owned by that User and shared data, including recipes, categories, production lists, menus, schedules, reports, notes, photos and membership information.
Deletion of a Workspace does not automatically delete the individual Accounts of the remaining members, but they lose access to the deleted Workspace and its data.
Before an operation that will delete a Workspace, Shixar should present the owner with a clear warning about the consequences.
Some data may remain for a limited period in technical backups in accordance with infrastructure retention cycles and should not be restored for ordinary use of the Service.
The Service Provider may retain limited information where necessary to comply with a legal obligation, establish, pursue or defend claims, document completion of a request or ensure security, where an appropriate legal basis exists.
10. Nature and limitations of Shixar
Shixar is a tool supporting the organization of work and information in hospitality. It is not a legal, accounting, tax, medical, HR/payroll service or a HACCP compliance certification.
Use of Shixar does not release a User, restaurant, employer or business from the obligation to comply with applicable laws.
Information entered by Users, including recipes, ingredients or other operational information, should be verified by the User where it may affect health, food safety or legal obligations.
The future introduction of features such as HACCP, allergens, calculations or AI may require additional rules or information.
11. Availability, updates and changes to the Service
The Service may be subject to interruptions related to maintenance, updates, failures, security, operation of infrastructure providers or events beyond the Service Provider’s reasonable control.
The Service Provider may change Shixar features for legitimate reasons, including development of the Service, security, compatibility, changes in law or prevention of abuse.
If rules concerning a digital service require specific notice to a Consumer about a change or grant the Consumer a right to terminate the agreement, the Service Provider will follow the applicable procedure.
12. Liability
The Service Provider is liable for providing Shixar in accordance with applicable law. These Terms do not exclude or limit liability or Consumer rights to the extent such exclusion or limitation would be legally impermissible.
The User is responsible for Content entered by the User and for the manner in which information in Shixar is used, to the extent provided by law.
The Service Provider does not guarantee the truthfulness, completeness or timeliness of Content entered by other Users.
The User should keep independent copies of particularly important materials where their loss could have significant consequences and making such a copy is technically possible.
13. Rights in Shixar
Rights in original Shixar elements, to the extent they belong to the Service Provider, remain with the Service Provider, subject to third-party rights and open-source licenses.
These Terms do not transfer intellectual property rights in Shixar to the User and do not affect the User’s rights in their own Content.
The User receives a limited, non-exclusive and non-transferable right to use Shixar in accordance with the intended purpose of the Service for the duration of the agreement.
14. Complaints
Complaints concerning the operation of Shixar may be sent to support@shixar.com.
Where possible, a report should contain information allowing the Account to be identified, a description of the issue, the time of occurrence and relevant technical information. The User should not send a password.
The Service Provider handles complaints without undue delay and within time limits resulting from applicable law.
Security matters may be sent to security@shixar.com, and personal-data matters to privacy@shixar.com.
15. Conformity of the digital service with the agreement
To the extent that rules on supplying digital content or digital services to consumers apply, the Service Provider supplies Shixar in accordance with those requirements.
If the Service does not conform to the agreement, the Consumer may use remedies provided by applicable law. These Terms do not restrict those rights.
The Service Provider provides updates, including security updates, to the extent required by applicable law.
16. Formation and termination of the agreement
An agreement for use of Account features is formed when an Account is correctly created and these Terms are accepted, where acceptance is required during registration.
The Account agreement is concluded for an indefinite period unless otherwise stated for a specific service.
The User may stop using Shixar by deleting the Account. Uninstalling the Application or logging out does not delete the Account.
Consumer rights concerning recovery of certain content provided or created while using a digital service remain unaffected to the extent required by law.
If the User acts on behalf of an Organization and the conditions described in Section 22 are met, acceptance of these Terms also covers the DPA version identified in these Terms, without the need for a separate statement in the interface.
17. Right of withdrawal
A Consumer concluding a distance contract has a right of withdrawal in the cases and within the time limits resulting from applicable law.
If the law requires obtaining from the Consumer a request to begin performance before the withdrawal period expires, express consent or information about the consequences of beginning performance, the relevant information and statements should be presented in accordance with law.
The introduction of paid plans will require renewed verification of information concerning withdrawal, payments and the terms of the relevant plan.
These Terms do not deprive a Consumer of a right of withdrawal where such right exists under mandatory law.
18. Restriction or suspension of access
The Service Provider may restrict or suspend access to an Account or features where justified by a serious breach of these Terms, unlawful activity, a security threat, an attempted unauthorized access, a legal obligation or the need to protect infrastructure.
Measures should be proportionate to the nature of the violation. Where legally and technically possible, the User will be informed of a material restriction and its reason.
The User may contact support@shixar.com to clarify the matter.
19. Changes to the Terms
These Terms may be changed for a legitimate reason, including changes in law, Shixar features, technology, security, plans or the Service Provider’s organization.
The Service Provider will inform existing Users of material changes in a manner appropriate to the nature of the change. If renewed acceptance is required, the User may be asked to provide it.
Changes do not deprive the User of rights arising under mandatory law. Previous versions of these Terms may be retained for evidentiary purposes.
A change to the DPA that requires renewed acceptance by an Organization may be communicated together with a change to these Terms or through another durable channel. Historical versions of the Terms and DPA may be retained for evidentiary purposes.
20. Discontinuation of Shixar
The Service Provider may decide to discontinue Shixar or a substantial part of the Service for economic, technical, legal, security or organizational reasons.
If discontinuation affects active Users, they will be informed with appropriate advance notice unless earlier discontinuation is required by law, security or circumstances beyond the Service Provider’s reasonable control.
If required by law, the User will be given the possibility to recover relevant Content. Personal-data obligations remain in force to the extent required by law.
21. Governing law and Consumers
These Terms are governed by Polish law, subject to mandatory provisions applicable to the User.
The choice of Polish law does not deprive a Consumer of protection granted by provisions that cannot be excluded by agreement.
The parties may seek an amicable resolution of a dispute, but this is not a mandatory condition for pursuing rights. Court jurisdiction is determined in accordance with applicable law.
22. Personal data
If a User uses Shixar solely for private purposes and does not entrust Shixar with data on behalf of an Organization, the DPA does not create a separate controller–processor relationship for such private use.
By accepting these Terms and then using Shixar on behalf of an Organization, an authorized User also accepts the DPA on behalf of that Organization to the extent the DPA applies. Shixar may record the version of the accepted Terms and DPA, the Account identifier, the Workspace identifier (if available), and the date and time of acceptance for evidentiary purposes.
If the Organization is the controller of personal data processed in its Workspace and Shixar acts as a processor in relation to that data, the Shixar DPA v1.1 applies and forms an integral part of the agreement to use Shixar to the extent personal data processing is entrusted to Shixar.
Rules concerning the processing of personal data are described in the Privacy Policy available at https://shixar.com/privacy.html. Privacy contact: privacy@shixar.com.

Matters not regulated by these Terms are governed by applicable law.
If any provision of these Terms is found invalid or ineffective, this does not affect the validity of the remaining provisions to the extent permitted by law.
Version 1.1 of these Terms is effective from October 13, 2026.
